LADD HILL BENGALS

ADOPTION AGREEMENT

Purchaser has paid a non-refundable deposit of $350.00 to hold Kitten for the Purchaser.  The deposit shall be applied towards the Purchase Price _________ which is due and payable on or before______________, or when the Kitten is collected, whichever is earlier.  In the event the Seller is unable to sell Kitten to the Purchaser, for reasons including, but not limited to, the Kitten’s mortality, Seller have the option of refunding the deposit or replacing the Kitten with a kitten of similar quality (Seller’s choice) as soon as one is available, usually within 9 months.

 

TERMS AND CONDITIONS

 

Purchaser acknowledges that he/she has been provided with a copy of Ladd Hill Bengals Kitten Care Sheet and that Purchaser has read and understood the contents of the Care Sheet.  Purchaser further agrees to follow all the important guidelines and suggestions outlined in the Care Sheet, since Purchaser’s failure to do so may lead to adjustment or health issues with Purchaser’s Kitten.

 

(1) We guarantee your cat/kitten is purebred and eligible for registration.  The cat/kitten listed above is a purebred Bengal cat, with an accurate pedigree, and is eligible for registration with The International Cat Association (TICA).

(2) Kitten shall be kept strictly indoors.  Purchaser shall not allow Kitten to roam outside, unless Kitten is leashed and accompanied by a responsible adult.

 (3) Kitten is sold only as a pet.  Kitten has been spayed or neuter.  Only in certain circumstances (health related) will the kitten be sold without spay or neutering.  In this case the purchaser agrees to spay or neuter the Kitten between 3 months and 6 months of age, and agrees to send us written verification of alteration from a licensed veterinarian.  The Verification of Alteration should include:  kitten’s registered name (if any), color, weight, breed, date of birth, and sex.  We agree to send registration papers to you within 30 days of receipt of the Verification of Alteration.

If we do not receive a valid Verification of Alteration by ________Ladd Hill Bengals has the right to reclaim the kitten without refund of purchase price.  In the event Kitten is found to be used for breeding, Seller shall be entitled to receive an additional payment of $5,000.00, within 7 days of written demand being made upon the Purchaser.

 (4) Kitten shall not be sold, leased, given away, abandoned to a shelter, pound, pet shop, research laboratory, humane organization, or any similar facility.  If Purchaser is unable to care for the Kitten, Purchaser shall notify the Seller immediately.  Purchaser shall use all reasonable effort to re-home the Kitten and Purchaser shall provide details, Names, phone number, and address of Kitten’s new owner to the Seller.  If a new suitable home cannot be found we agree to take back the kitten/cat under the agreement that there is no refund.  Transportation of kitten back to breeder is at the owner’s expense.

 (5) Purchaser shall care for the Kitten with a proper diet, housing, health and general care, including maintaining up to date vaccines and proper parasite prevention.  Purchaser agrees to NEVER MUTILATE or DECLAW a Ladd Hill Bengals Cat or Kitten including tendonectomy and Ventriculocordectomy (ANY MUTILATION other than dessexing, voids all health guarantees). If we find any Ladd Hill Bengals cat to have been mutilated as said above, legal action will be taken.

If, in Seller’s opinion, Kitten is neglected or mistreated, Purchaser shall surrender Kitten to Seller unconditionally. “Neglect” or “mistreatment” shall include, but not be limited to, leaving Kitten alone without human companionship for periods in excess of 72 hours, lack of proper sanitary facilities, lack of proper veterinary/medical attention, food or water, physical abuse, or being kenneled in a small carrier other than trips or transporting.  Any and all fees associated with the recovery of Kitten shall be paid by the Purchaser, including, but not limited to, any and all court costs and attorney’s fees.

 (6) Seller makes no guarantees as to the Kitten’s temperament.  We pride ourselves on socializing our kittens, but we cannot predict how the Kitten will act after it leaves the familiar environment of our cattery and its litter mates.  It is Purchaser’s responsibility to slowly transition Kitten to its new home.  Purchaser acknowledges that some kittens may take longer than others to adjust to their new surroundings.  Purchaser must notify Seller immediately if kitten is not transitioning well into its new home (e.g. not using the litter box…) so that Seller is made aware of any issues.  If Purchaser has any health or behavior concerns about the Kitten, Purchaser must notify Seller of the concerns immediately.  We cannot help you with these concerns if we are not aware of them.

(7) We cannot assume responsibility for your cat allergies, disapproval of landlord, lack of proper house training for your cat/kitten, personality of cat/kitten, etc.  We are not responsible for any damage to property, injury to humans or animals, or death caused by your cat/kitten.

(8) Purchaser agrees that he/she will feed Kitten the same food that Kitten was eating at the Seller's premises for at least 3 months, and any changes to the Kitten's diet will be done gradually.  Any sudden changes to the Kitten's diet may result in diarrhea.

(9) Seller warrants that Kitten was fully litter box trained when Kitten left Seller's premises.  However, the new surroundings may confuse the Kitten and may result in improper elimination.  Purchaser needs to ensure that Kitten knows where its new litter box is located, and Seller recommends that Purchaser use the same type of litter box and litter used at Seller's premises, to avoid confusing the Kitten.  

 (10) This sale is final and there are no cash refunds, unless agreed upon by the seller.

HEALTH GUARANTEE

 (1) The cat/kitten is guaranteed to be of sound health at the time of sale. This kitten is guaranteed to be healthy and free of disease and other health related conditions originally present at the time of purchase unless otherwise indicated and agreed on by Purchaser and Seller in the terms section of this contract.

(2) The cat/kitten is guaranteed for three days from the time of receipt. It is required that the cat/kitten be quarantined during this time. If a licensed Veterinarian finds the cat/kitten not to be of sound health within three days of the date of sale, the cat/kitten may be returned with a written statement signed by the licensed Veterinarian for a full refund or replacement cat/kitten of equal value. Stress-related issues are not part of this health guarantee and will not be covered. All vet bills are the responsibility of the purchaser.

(3) The cat/kitten must remain quarantined from other pets until the first vet check. Please note that failure to do this will render all guarantees null and void.

(4) The cat/kitten may not be given the FIP vaccine. If the FIP vaccine is administered, the Health Guarantee becomes null and void.

(5) The cat/kitten is guaranteed to be clear of genetic diseases, including FIP, for two years. If a diagnosis of genetic disease is made within 2 years of its life, a replacement kitten of equal value will be granted. Purchaser must provide the veterinarian’s written report confirming in writing, that in their opinion, the Kitten has a genetic disease. If the Seller stops breeding, a replacement will not be granted.

 

 Seller recommends AGAINST the use of Ketamine as anesthesia. There have been reports of Bengals dying with the use of Ketamine as anesthesia.  Isoflurane has proved to be a much safer anesthesia for Bengals.  Please discuss this with your vet.

 

 RETURN POLICY

 

Kitten may not be returned after the 3-day health guarantee period or if Kitten has been exposed to another kitten, cat or other animal, if Kitten is allowed outside or if Kitten was not housed in a clean and safe environment.

 

 GOVERNING LAW

 

This Agreement shall be final and binding upon the Purchaser and Seller and shall be governed by the laws of the State of Oregon.  Parties shall submit all their disputes arising out of or in connection with this Agreement to the exclusive jurisdiction of the Courts of Oregon.  In the event of a dispute between the parties, the prevailing party shall be entitled to his/her attorney’s fees and all costs and expenses associated with the dispute.
